GARDNER and spouse, if any, or any other person or entity claiming thereunder, ALEXANDER B. GARDNER, JR. and spouse, if any, and all possible heirs and assigns of ALEXANDER B. GARDNER, JR. and spouse, if any, or any other person or entity claiming thereunder, RANDALL J. GARDNER and spouse, if any, and all possible heirs and assigns of RANDALL J. GARDNER and spouse, if any, or any other person or entity claiming thereunder, DARYL K. GARDNER and spouse, if any, and all possible heirs and assigns of DARYL K. GARDNER and spouse, if any, or any other person or entity claiming thereunder, and THE HEIRS, ASSIGNS and DEVISEES of MICHAEL JEROME GARDNER and spouse, if any which may include ERICA LYNNE GARDNER and spouse, if any, or any other person or entity claiming thereunder, et al, 15-CVD-383, the undersigned Commissioner will on the 18th day of July, 2022, offer for sale and sell for cash, to the last and highest bidder at public auction at the courthouse door in Yadkin County, North Carolina, Yadkinville, North Carolina at 12:00 o'clock, noon, the following described real property, lying and being in Knobs Township, State and County aforesaid, and more particularly described as follows:

    All that certain tract or lot of land lying in Knobs Township, Yadkin County, State of N.C. and described as follows:
    Beginning at an iron on South side of Wilkesboro road, runs North 82 deg. West with road 140 ft. to Joe Dowells corner then South 46 deg. East 125 ft. to the corner, then east with John Garris line 160 ft. to an iron William Gwyn cor. then North 57 deg. 30 West 121 ft. to an iron, the beginning. Containing 18.300 square feet more or less.
    Subject to restrictive covenants and easements of record.

    The undersigned Commissioner makes no warranties in connection with this property and specifically disclaims any warranties as to title and habitability.  This property is being sold as is, without opinion as to title or any other matter.

    This sale will be made subject to all outstanding city and county taxes and all local improvement assessments against the above described property not included in the judgment in the above-entitled cause.  A cash deposit of 20 percent of the successful bid will be required.  In addition, the successful bidder will be required, at the time the Deed is recorded to pay for recording fees and revenue stamps assessed by the Yadkin County Register of Deeds.

    This sale is subject to upset bid as set forth in N.C.G.S. Section 1-339.25.
